State Senate unanimously passes Adult Survivors Act

ALBANY — State senators unanimously voted Thursday to pass the Adult Survivors Act to open a look-back window for survivors of sexual abuse to file litigation against their accusers.

Senators voted 62-0 to pass S.66, or the Adult Survivors Act, to give people ages 18 and older one year to file civil lawsuits for past sexual abuse and hold abusers accountable, even if statutes of limitations on those legal claims have expired.

Two days ago, I emailed the New York State Bar Association, which is widely acclaimed for its pro bono and justice initiatives.

I asked what initiatives it's taken to address the crisis of thousands of survivors who have been unable to retain attorneys to file claims under the Child Victims Act?

Greenberg is correct. The crisis will expand and enlarge under the Adult Survivors Act.

Here is the response I received from the New York State Bar Association:

"The Association has not reviewed the issue and has not issued a comment on the issue."

Once the look-back windows of the Child Victims Act and the Adult Survivors Act are exhausted, NY will have on its hands thousands of survivors prevented from seeking justice. The re-victimization is heartbreaking and unconscionable. It's nothing short of a justice and humanitarian crisis.
